1. Introduction

Welcome to Waves Curtains And Blinds ("the Company," "we," "us," or "our"). We operate the website https://wavescurtainsandblinds.ae/ and provide a range of custom-made curtains, blinds, and related services, including measurement, manufacture, delivery, and installation, within Dubai and the UAE.

These Terms and Conditions govern your use of our website and all sales and services provided by the Company. By placing an order, engaging our services, or using our website, you agree to be bound by these Terms and Conditions in full.

2. Orders and Quotations

• Quotations: All quotations provided by the Company are valid for a period of [e.g., 14/30] days unless otherwise stated in writing. A quotation does not constitute a binding contract until an order confirmation is issued by the Company.
• Order Confirmation: An order is deemed accepted and a binding contract is formed only when the Company provides you (the "Customer") with a written Order Confirmation and receives the required deposit/full payment.
• Order Changes and Cancellations:
  • Due to the custom-made nature of our products, changes or cancellations to an order can only be accepted within [e.g., 24 to 48] hours of the Order Confirmation.
  • Any changes requested after this period are at the sole discretion of the Company and may incur additional charges or delays.
  • Cancellation requests made after the initial change window will result in the forfeiture of the deposit and may incur additional charges for materials or work already completed.

3. Pricing and Payment

• Pricing: All prices quoted are in UAE Dirhams (AED) unless otherwise specified. Prices are exclusive of any applicable taxes, duties, or transit costs unless explicitly included in the quotation.
• Payment Terms:
  • A [e.g., 50%] deposit of the total order value is required at the time of placing the order and receiving the Order Confirmation.
  • The remaining [e.g., 50%] balance must be paid in full on or before the day of installation/delivery.
  • For online orders, full payment is typically required at the time of order placement.
• Non-Payment: Title to the goods does not pass to the Customer until full payment for the goods and services has been received by the Company in cleared funds. If payment remains outstanding, the Company reserves the right to withhold delivery/installation and/or remove any installed products.

4. Measurements and Specifications

• Company Measurement Service: If the Company provides the measurement service, we are responsible for the accuracy of those measurements. In the event of an error by the Company, we will rectify the issue at no additional cost.
• Customer Measurements: If the Customer provides the measurements for the products, the Customer is solely responsible for their accuracy. The Company will manufacture the product strictly to the specifications provided. We will not be liable for products that do not fit due to incorrect measurements supplied by the Customer.
  No refunds or replacements will be offered in this case.
• Product Variation: Curtains and blinds are made-to-measure products, and slight variations in colour, pattern, shade, and dimensions may occur due to dye lots, fabric characteristics, and manufacturing processes.
  • Screens may not accurately represent true fabric colour; we strongly recommend ordering samples before final confirmation.
    The Company will not refund or replace products based on discrepancies solely due to screen display.

5. Delivery and Installation

• Delivery Timeframes: Any timeframes provided for delivery and installation are estimates only and are subject to change due to unforeseen circumstances (e.g., material supply issues, shipping delays, customs). The Company will make reasonable efforts to meet estimated timeframes but will not be liable for any losses or damages caused by reasonable delays.
• Site Access and Preparation: The Customer must ensure clear, safe, and unobstructed access to the installation area. If furniture or existing window coverings need to be moved or removed, it is the Customer's responsibility to do so before the installation team arrives. Failure to provide proper access may result in a delayed installation and an additional rescheduling fee.
• Concealed Items: The Customer is responsible for informing the Company of any concealed items (e.g., pipes, wiring) within the mounting areas. The Company is not responsible for damage to unmarked or concealed items.

6. Warranty and Defects

• Warranty: The Company offers a limited warranty on our products and installation services against manufacturing defects and installation faults. The standard warranty period for mechanisms and components is [e.g., one (1)] year from the date of installation. Fabric fading or deterioration due to natural use or improper care is generally not covered.
• Defects: The Customer must inspect the products immediately upon delivery or completion of installation. Any claim for visible defects or damage must be notified to the Company within seven (7) days of delivery/installation, providing photo or video evidence. After this period, the Customer is deemed to have accepted the goods in good order.
• Exclusions: The warranty does not cover:
  • Damage resulting from misuse, abuse, accidents, improper cleaning, or failure to follow care instructions.
  • Alterations or repairs made by any party other than the Company.
  • Normal wear and tear.

7. Limitation of Liability

To the maximum extent permitted by UAE law, Waves Curtains And Blinds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the website or the purchase and use of our products/services. Our total liability to you for any claim arising out of an order will be limited to the total price paid for the product(s) in question.

8. Intellectual Property

All content on this website, including text, graphics, logos, images, and product designs, is the property of Waves Curtains And Blinds or its content suppliers and is protected by copyright and intellectual property laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the website without express written permission from the Company.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the Federal Laws of the United Arab Emirates. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts of Dubai, UAE.
